AeroTrack (the “Service”) is a continuing-airworthiness and maintenance operations platform provided by Nirnay AI (“we”, “us”). By accepting these Terms of Use (the “Terms”) — or by accessing or using the Service — you agree to be bound by them personally, in addition to any agreement between Nirnay AI and the organisation that provisioned your access (your “Organisation”). If you do not agree, do not use the Service and sign out.
The Service supports airworthiness management, maintenance planning and records for aircraft operators, including operations regulated by the Directorate General of Civil Aviation (India). It includes all screens, workflows, reports, documentation and assistance features made available to you, and any updates, modifications or new features we add — no separate acceptance is needed when the software changes.
Your account is personal. Keep your credentials confidential, do not share your session, and tell your Organisation’s administrator promptly if you believe your account has been compromised. Access is provisioned and may be withdrawn by your Organisation; actions taken under your account are recorded in the Service’s audit trail and attributed to you.
You receive a limited, revocable, non-exclusive, non-transferable right to use the Service for your Organisation’s internal airworthiness and maintenance operations. You must not, and must not help or engage anyone else to:
Nothing in this section limits your ordinary use of the Service for its intended purpose, including sharing its outputs within your Organisation and with your regulator or auditors.
The non-public aspects of the Service — its design, workflows, compliance logic, documentation, pricing and roadmap — are the confidential information of Nirnay AI. You may use them only to use the Service, and must not disclose them except as required by law or with our written consent. This obligation survives the end of your access.
Data your Organisation enters into the Service (fleet, maintenance, personnel and operational records) belongs to your Organisation. We process it to provide, secure and improve the Service and as agreed with your Organisation, and we protect it in line with applicable Indian law, including the Digital Personal Data Protection Act, 2023 to the extent it applies. The Service keeps an append-only audit trail of actions taken in it; that trail is part of the record the Service exists to provide and cannot be edited on request.
Nirnay AI owns the Service and everything in it other than your Organisation’s data, including all software, designs, content and trademarks. If you give us feedback, suggestions or ideas about the Service, we may use them without restriction or obligation to you — this is how tester feedback becomes product improvements.
We develop the Service continuously and may change, add or retire features at any time. We aim for high availability but do not promise uninterrupted or error-free operation, and we may suspend the Service for maintenance or security reasons.
The Service assists with airworthiness management; it does not replace it. Regulatory responsibility for the continuing airworthiness of an aircraft — including the accuracy of data entered, the validity of maintenance decisions and compliance with DGCA or other applicable requirements — remains at all times with the certificate holders and approved persons of your Organisation. Always verify safety-critical information against controlled source documents.
To the maximum extent permitted by law, Nirnay AI is not liable for indirect, incidental, special or consequential loss, loss of profits or loss of data arising from use of the Service, and our total liability for all claims relating to the Service is limited to the amounts paid by your Organisation for the Service in the twelve months before the claim arose. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
We may suspend or end your access if you materially breach these Terms — in particular Section 4 or 5 — or if your Organisation’s agreement with us ends. Sections 4, 5, 6, 7, 10 and 13 survive termination.
We may update these Terms. If a change materially affects your rights or duties, the Service will ask you to review and accept the updated version before continuing — with a summary of what changed. Minor clarifications may be made without re-acceptance; the current version and its effective date are always shown at the top of this page.
These Terms are governed by the laws of India, and the competent courts in India have exclusive jurisdiction over disputes arising from them or from use of the Service.
